What is the Lawsuit About?
A former Assistant Store Manager for Food Lion has filed a case against Food Lion for failure to pay overtime. The case, entitled Ratcliffe v. Food Lion, No. 18 Civ. , is currently pending before Judge Richardson in the Eastern District of Tennessee. The lawsuit alleges that Food Lion misclassified Assistant Store Managers as exempt from overtime and paid them only a salary, even though they were entitled to overtime pay when they worked more than 40 hours a week. On November 29, 2018, the plaintiff filed a motion for conditional certification, asking to send notice of the lawsuit to current and former ASMs who worked for Food Lion company wide. On August 16, 2019, the court issued an order denying Plaintiff’s motion. Plaintiff has filed a motion asking the court to reconsider that order. That motion is currently pending before the court.
