What is this lawsuit about?
A former Assistant Store Manager for Food Lion has filed a case against Food Lion for failure to pay overtime. The case, entitled Ratcliffe v. Food Lion, No. 18 Civ. 1177, is currently pending before Judge Richardson in the Eastern District of Tennessee. The lawsuit alleges that Food Lion misclassified Assistant Store Managers (“ASMs”) as exempt from overtime and paid them only a salary, even though they were entitled to overtime pay when they worked more than 40 hours a week. On November 29, 2018, the plaintiff filed a motion for conditional certification, asking to send notice of the lawsuit to current and former ASMs who worked for Food Lion company wide.
The court initially denied the plaintiff’s motion, but after the plaintiff filed a motion asking to reconsider its decision, the court granted the conditional certification motion on November 21, 2019. This means that current and formers ASMs who worked for Food Lion during a certain period will receive a mailed notice that describes this lawsuit and their option to join.
